Xaccel Networks LLC (“Xaccel,” “we,” “our,” or “us”) operates a cloud-based unified communications platform providing SMS and MMS-enabled telephone numbers to business customers and their employees. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you use our platform, website, and services (collectively, the “Services”). Please read this policy carefully. By using our Services, you agree to the practices described herein.

Information We Collect

We collect information you provide directly to us when you register for an account, use our platform, or communicate with us. This includes:

  • Identity Information: Full name, business name, job title, and contact details including email address and phone number.
  • Business Information: Company legal name, Employer Identification Number (EIN), state of incorporation, business address, and business standing verification data.
  • Account Credentials: Username and encrypted password.
  • Communications Data: Metadata associated with SMS and MMS messages sent and received through our platform, including sender number, recipient number, timestamp, message length, and delivery status. We do not store the content of messages beyond what is necessary for delivery confirmation and compliance logging.
  • Device and Usage Information: IP address, device type, operating system, browser type, pages visited, and features used within our platform.
  • Payment Information: Billing address and payment method details, processed securely through our payment processor. We do not store full payment card numbers.

How We Use Information

We use the information we collect for the following purposes:

  • To provide, operate, and maintain our communications platform and Services
  • To verify your identity and business standing as part of our onboarding process
  • To assign and manage telephone numbers (DIDs) to your account
  • To route inbound and outbound SMS and MMS messages on your behalf
  • To enforce our compliance obligations under CTIA guidelines and The Campaign Registry (TCR) requirements
  • To monitor for abuse, fraud, and violations of our Acceptable Use Policy
  • To send you service-related communications including account alerts and compliance notifications
  • To respond to your inquiries and provide customer support
  • To improve and develop our Services
  • To comply with applicable laws and regulations

We do not sell, rent, or trade your personal information to third parties for their marketing purposes.

Section 03

SMS and MMS Messaging

Our platform provides SMS and MMS messaging capabilities to registered business users. By registering and activating messaging on our platform, you acknowledge and agree to the following:

  • Consent to Messaging: During account registration, you provide explicit consent to send and receive SMS and MMS messages through your assigned telephone number. This consent is captured at registration and must be actively confirmed before messaging is activated on your account.
  • Opt-Out: You may opt out of messaging at any time by texting STOP to your assigned number or by disabling messaging through your account settings. Upon opt-out, messaging will be deactivated immediately.
  • HELP: Text HELP to your assigned number at any time to receive assistance information.
  • Message and Data Rates: Standard message and data rates may apply depending on your mobile carrier plan.
  • Compliance: All messaging activity on our platform is subject to CTIA Messaging Principles and Best Practices, The Campaign Registry (TCR) requirements, and applicable carrier regulations. We enforce rate limits, duplicate content detection, and other compliance controls to ensure lawful use of our platform.
  • No Unauthorized Marketing: Our platform is for person-to-person business communication only. Bulk messaging, marketing broadcasts, and automated messaging are not permitted and are actively blocked by our compliance systems.

Message logs including metadata (sender, recipient, timestamp, delivery status) are retained for compliance and audit purposes for a period of 90 days. Message content is not stored beyond delivery confirmation.

Information Sharing and Disclosure

We do not sell your personal information. We may share your information in the following limited circumstances:

  • Service Providers: We share information with trusted third-party vendors who assist in operating our platform, including our telecommunications carrier (Bandwidth Inc.), The Campaign Registry (TCR), and cloud infrastructure providers. These parties are contractually bound to use your information only to provide services to us.
  • Carriers and Regulators: We are required to share certain campaign and brand registration information with mobile network operators (AT&T, T-Mobile, Verizon) and TCR as part of our A2P 10DLC compliance obligations.
  • Business Verification: We share your business name, EIN, and state of incorporation with third-party identity verification services to confirm your business is registered and in good standing.
  • Legal Requirements: We may disclose your information if required to do so by law, court order, or government authority, or to protect the rights, property, or safety of Xaccel, our users, or the public.
  • Business Transfers: In the event of a merger, acquisition, or sale of all or part of our assets, your information may be transferred as part of that transaction. We will notify you of any such change.
Section 05

Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with our Services. Specifically:

  • Account data is retained for the duration of your account and for up to 3 years after account closure for legal and compliance purposes.
  • Message metadata (sender, recipient, timestamp, delivery status) is retained for 90 days for compliance and audit purposes.
  • Message content is not stored beyond delivery confirmation.
  • Compliance and audit logs are retained for 2 years.
  • Billing records are retained for 7 years in accordance with applicable tax and financial regulations.

You may request deletion of your personal data at any time by contacting us. We will process deletion requests within 30 days, subject to any legal obligations that require us to retain certain information.

Security

We implement industry-standard technical and organizational security measures to protect your information, including:

  • TLS encryption for all data in transit
  • Encrypted storage of passwords using bcrypt hashing
  • Multi-factor authentication (MFA) enforcement for all platform accounts
  • Role-based access controls limiting data access to authorized personnel
  • Continuous security monitoring via SIEM platform with custom anomaly detection rules
  • Web Application Firewall (WAF) protection via Cloudflare
  • Regular security assessments and vulnerability management

While we take reasonable steps to protect your information, no security system is impenetrable. In the event of a data breach that affects your personal information, we will notify you as required by applicable law.
